Tether is experiencing increased scrutiny over the future of its stablecoin, USDT, in the United States. The company must comply with the requirements set forth in the GENIUS Act to ensure continued availability on U.S. crypto platforms ahead of a compliance deadline in 2028.

Implications of the GENIUS Act

Industry experts indicate that if Tether fails to meet the GENIUS Act requirements, it may face restrictions that could limit USDT’s presence in the U.S. market. While foreign stablecoin issuers, like Tether, have a grace period, certain obligations may commence as soon as the law goes into effect in January.

Tether’s Regulatory Path

The GENIUS Act was signed into law by President Donald Trump, establishing a three-year transition period for compliance. Many in the legal field debate whether the same timeline applies to foreign issuers. Tether has yet to outline its strategy for complying with these regulations, although CEO Paolo Ardoino previously stated the company’s commitment to adherence.

“Tether will comply with the GENIUS Act,” Ardoino remarked in a previous interview.

Compliance Timeline Uncertainties

With a notable deadline in July 2028, questions linger regarding compliance timelines for foreign issuers. Legal advisor Justin Levine explained that while immediate cooperation with lawful asset seizures linked to illicit activities is required of foreign issuers once the law becomes effective, broader compliance for continued U.S. listings will take more time to implement.

Reserve Structure Concerns

Recent disclosures from Tether reveal that about a quarter of USDT’s reserves are invested in assets that do not align with the GENIUS Act’s requirements. The law mandates stablecoins be backed by highly liquid assets such as cash and short-term U.S. Treasury securities.

Tether’s Ongoing Expansion

Despite regulatory uncertainties in the U.S., Tether continues to grow its business operations and investment strategies globally. The firm recently invested $20 million in the Brazilian exchange Mercado Bitcoin and another $20 million in the Argentine digital bank Ualá as part of its drive to expand cryptocurrency payment solutions.

Monitoring the Regulatory Landscape

As compliance discussions progress, the implementation of the GENIUS Act remains pending, leaving stablecoin companies, including Tether, navigating an incomplete regulatory framework. Market analysts suggest that trading platforms with cautious approaches may begin delisting non-compliant stablecoins prior to the deadline.

As Tether and others prepare for upcoming federal oversight, the focus within the cryptocurrency community is also shifting toward other proposed legislation such as the CLARITY Act, potentially complicating the compliance landscape further.
