South Africa’s National Treasury Proposes New Crypto Regulations

On August 4, 2026, South Africa’s National Treasury and the South African Reserve Bank (SARB) announced a proposed draft rulebook aimed at regulating cryptocurrency usage for cross-border transactions. The new framework mandates that any cryptocurrency sent offshore must go through an authorized provider and be reported to the central bank’s Financial Surveillance Department (FinSurv).

Aiming for Compliance and Oversight

In a joint statement, both agencies indicated that the regulatory measures are designed to reduce the risk of regulatory arbitrage among regulated entities involved in cross-border activities. Additionally, these rules aim to bolster the capability of FinSurv to detect and prevent illicit financial flows.

No Change to Legal Status of Crypto

The proposed regulations will not change the legal status of cryptocurrencies in the country, nor will there be any differentiation made between various digital assets. The draft is open for public comment, with submissions due by September 30.

Building on Previous Regulations

This move builds on earlier regulations issued by the National Treasury in April, which called for crypto holders to declare assets exceeding a specific threshold and provide private keys to enforcement officers upon request.
