National Police Union Endorses CLARITY Act Amid Legislative Uncertainty

The National Fraternal Order of Police (FOP), representing over 382,000 law enforcement members in the United States, has shifted its stance and now supports the revised CLARITY Act. This decision comes after lawmakers made modifications that address the union’s concerns related to cryptocurrency investigations.

Support for Investigative Powers

In a letter addressed to Senate Banking Committee Chairman Tim Scott and ranking member Elizabeth Warren, FOP National President Patrick Yoes expressed support for the latest version of H.R. 3633, known as the Digital Asset Market Clarity Act. Yoes emphasized that the revised Section 10604, which amends the Blockchain Regulatory Certainty Act (BRCA), ensures that law enforcement and prosecutors retain the authority needed to investigate crimes involving digital assets.

Concerns Addressed

The FOP highlighted that the new provisions help federal, state, and local agencies combat financial crimes linked to digital assets. The union underscored the need for clear authority to tackle fraud, organized crime, and illicit finance that can emerge within cryptocurrency networks.

Among the supportive provisions outlined by the union are safeguards against fraud related to digital asset kiosks, which align with anti-money laundering measures applicable throughout the crypto industry. Additionally, the FOP noted that the measures would enable investigators to temporarily hold suspicious transactions, allowing time to prevent further financial losses and aid in recovering stolen assets.

Legislative Challenges Ahead

Despite the FOP’s endorsement, the CLARITY Act faces significant hurdles as Congress heads toward the August recess. Senate Majority Leader John Thune has indicated that the Senate is unlikely to pass the legislation before adjournment, leading to a decrease in the probability of the bill becoming law this year to just 33% according to Polymarket traders.

Political tensions surrounding the upcoming midterm elections may further complicate the bill’s prospects, with some lawmakers hesitant to support major cryptocurrency legislation prior to the elections, as noted by Ron Hammond, head of policy and advocacy at Wintermute.

A Call for Cooperation

In the letter, the FOP described the revisions as an important step towards providing better resources for law enforcement. The union is eager to collaborate with lawmakers to ensure the revised bill’s passage, reinforcing its commitment to enhancing the tools and clarity needed in cryptocurrency investigations.
