Dutch Authorities Liquidate Seized Cryptocurrency
Dutch prosecutors have completed the sale of cryptocurrency seized from the now-bankrupt trading platform Knaken for €2.2 million (approximately $2.5 million). This sale marks a significant step in addressing the financial fallout from Knaken’s collapse, as customer claims against the exchange are estimated to reach between €10 million and €12 million.
Background on Knaken’s Bankruptcy
The bankruptcy of Knaken was officially ordered by a Rotterdam court on July 16, following a request from the Dutch Public Prosecution Service, which alleged that approximately €7 million in customer funds could not be accounted for. The prosecutors asserted that the company lacked sufficient assets to fully repay its users. Knaken had ceased operations by early June, effectively cutting off access for customers who had relied on its services for buying, trading, and storing cryptocurrency.
Impact on Customers
With around 6,300 customers directly affected, trustee Carl Hamm has advised them to manage their expectations regarding recoveries, given the significant disparity between the claims submitted and the liquidated cryptocurrency assets. Hamm indicated that while customers believed they owned the cryptocurrency displayed in their accounts, legally, the corresponding positions were owned by Knaken.
Ownership and Legal Controversies
Customer representatives have raised concerns regarding the sale of the seized crypto before resolving ownership issues, likening it to a scenario where a garage sells a vehicle that does not belong to it. While prosecutors have defended the sale, citing potential depreciation of the cryptocurrency’s value, specific reasons for liquidation were not disclosed.
Financial Difficulties and Previous Incidents
The financial challenges for Knaken trace back to a 2020 hack during which 23 BTC were stolen, ultimately costing the firm millions. Despite this incident, Knaken continued to attract customers and form sponsorship deals with various Dutch football clubs.
Ongoing Investigations
Investigations into Knaken’s financial operations continue, particularly regarding how customer funds were managed and whether the company held adequate cryptocurrency reserves corresponding to account balances. Hamm noted inconsistencies in the way customer funds were invested and operational expenditures were reported.
