Clarity Act Passage Odds Hit Record Low Amid Senate Delays

Traders on Polymarket have significantly lowered their expectations for the Clarity Act, now estimating only a 32% chance of its passage by the end of 2026. This marks the lowest likelihood since the market’s inception in January 2026, reflecting growing concerns about the bill’s viability as Senate negotiations over key ethics provisions remain unresolved.

Shifting Odds and Legislative Challenges

As of last Friday, the chances of the Clarity Act becoming law have dropped approximately 30 percentage points from its peak of 82% on February 19. This decline has coincided with the narrowing of the Senate’s legislative calendar and increasing doubts regarding the bipartisan support necessary to move the bill forward.

Despite ongoing negotiations, recent efforts to introduce an updated legislative text have yet to secure Democratic backing. Concerns about ethics provisions continue to be a major sticking point, with Senator Ruben Gallego (D-Ariz.) stating he will not support the bill without these provisions.

Support for the Clarity Act

If enacted, the Clarity Act aims to establish a federal framework clearly delineating which digital assets fall under the jurisdiction of the SEC and which are overseen by the CFTC. Proponents argue it would replace the current regulatory approach of enforcement with clearer, legislatively defined rules.

During a recent House hearing, industry representatives stressed the necessity of the legislation. Nova Labs executive Sarah Aberg emphasized that the current regulatory uncertainty is hindering investment, citing the SEC’s past actions against the Helium project. “Clarity is not a call for deregulation; it is a call for the right regulation from the right regulator,” Aberg stated.

Additional voices from the industry, such as those from Bullish and WisdomTree, reiterated the need for durable regulations to provide consistency irrespective of changing political landscapes while safeguarding investor interests and software developers.

Looking Ahead

As Congress prepares for its August recess, the window for the Clarity Act to reach the president’s desk before year-end continues to narrow. With no public updates from the recent meetings, the outlook for the legislation remains uncertain, leaving traders and industry stakeholders increasingly skeptical about its future.
