The Austrian Financial Market Authority (FMA) has imposed a fine of €70,000 (approximately $82,000) on Bitpanda, marking the first final penalty issued under the European Union’s Markets in Crypto-Assets Regulation (MiCA). The decision highlights significant breaches related to disclosure and marketing practices.

Details of the Violations

According to the FMA, Bitpanda failed to submit the required crypto-asset white paper at least 20 working days prior to its publication, violating established MiCA guidelines. Additionally, the company distributed marketing materials before the white paper was released, which did not include essential disclosures or contact information, further contravening EU regulations.

Key Findings by the Regulator

The FMA’s investigation revealed that one significant infraction was the timing of the submission for the crypto-asset white paper. MiCA stipulates that this document must be presented to the national regulator well in advance of public availability. Bitpanda’s failure to comply has led to this penalty.

Moreover, the marketing materials released by Bitpanda were found lacking in mandatory disclosures stating that the material had not been reviewed or approved by any competent authority, thus placing the responsibility solely on the company.

Expedited Penalty Process

The penalty was processed through an expedited procedure, with the FMA confirming that this decision is now final. The Austrian regulator’s action serves as a demonstration of its enforcement capabilities under the newly implemented MiCA framework.

Bitpanda’s Regulatory Background

Despite the recent fine, Bitpanda has already secured necessary regulatory approvals, enabling it to offer crypto services throughout the European Union. In early 2025, Germany’s Federal Financial Supervisory Authority granted the company a MiCA license, allowing it access to the EU’s passporting system for financial services.
