Two significant internet safety bills, the Kids Internet and Digital Safety Act in the US and the EU’s Chat Control 2.0, were recently debated amidst fierce scrutiny. Both bills have faced considerable opposition, resulting in a retreat from their most controversial provisions. Yet, a key aspect – mandatory age verification – remains largely unchallenged, raising concerns about privacy and surveillance for all users.

The Evolving Legislative Landscape

The Kids Internet and Digital Safety Act was passed by the US House with a vote of 267 to 117. Simultaneously, negotiators in Brussels engaged in what was touted as the final trilogue for the Chat Control 2.0 child protection regulation. While both pieces of legislation saw amendments, age verification stayed intact, positioning it as a cornerstone of these new regulations.

Concerns Over Privacy

According to Evin McMullen, CEO of Billions Network, mandatory age verification transforms anonymous browsing into a system where identities are recorded, contradicting the very notion of privacy. Each attempt to verify age often necessitates collecting users’ identities, thereby creating centralized databases of sensitive information.

The Electronic Frontier Foundation highlighted this issue, stating that the requirement for age verification leads to extensive pools of personal data that could be breached, subpoenaed, or sold. This is not merely theoretical; real-world applications, such as the UK’s Online Safety Act, have already prompted users to submit government IDs or facial recognition data to access various sites.

A False Dichotomy

McMullen emphasizes that current conversations surrounding age verification frame the dialogue inaccurately. Legislators present a binary choice: safety versus freedom, while critics emphasize protection versus privacy. However, the reality is that age verification does not inherently require the collection of identities. Advanced technologies, such as zero-knowledge proofs, can establish a user’s age without revealing personal information.

The Need for Privacy-preserving Measures

While the EU has made strides with its age-verification app designed to ensure users can prove their age without divulging additional personal information, legislative measures often fail to mandate such privacy-preserving technologies. Instead, they permit whichever method is cheapest, often resulting in invasive practices like identity uploads and facial scans.

Potential Implications and Solutions

The ongoing development of AI and digital services necessitates a careful approach to identity verification. As both legislative bodies have settled on the foundational principle of distinguishing adults from children in online spaces, the focus shifts to whether these capabilities will be implemented with robust privacy protections or through expansive surveillance mechanisms.

Protecting children online is undoubtedly essential, but safeguarding privacy remains equally critical for diverse groups, including activists, survivors of abuse, and media professionals. The technology exists to verify age without compromising the individual’s identity. The pivotal question now rests with lawmakers: will they embrace these privacy-centric solutions, or will we end up with a global identity tracking system masked as child safety measures?
