In a significant move, prediction market operator Novig has filed a lawsuit against Wisconsin Attorney General Josh Kaul and state gaming administrator John Dillett. The suit, filed on August 14 in the U.S. District Court for the Western District of Wisconsin, seeks to block the application of state gambling laws to sports event contracts traded on Novig’s federally regulated exchange.

Novig’s complaint argues that federal commodities law should take precedence over Wisconsin statutes, particularly concerning the federally regulated derivatives that Novig offers. The Commodity Futures Trading Commission (CFTC) designated Ludlow Exchange – operated by Novig – as a contract market on June 16, allowing for federally regulated trading of its event contracts. The company began providing these contracts to Wisconsin residents shortly before initiating legal action.

Notably, Novig’s suit comes against the backdrop of a challenging legal environment. Prior to this, a Wisconsin federal judge denied the CFTC’s request for preliminary relief against state enforcement actions related to prediction markets. Wisconsin had previously taken action against similar platforms, including Kalshi and Polymarket, alleging that their event contracts constituted unlawful gambling.

Novig is seeking both preliminary and permanent injunctions, as well as a declaration affirming that state laws do not apply to its sports contracts under federal regulation. The lawsuit reflects a broader conflict between federal and state authorities over the governance of prediction markets.
