Kalshi Ordered to Keep Operations Open Amid Washington Restrictions
Kalshi Ordered to Keep Operations Open Amid Legal Challenges
The Commodity Futures Trading Commission (CFTC) has mandated that Kalshi continue its business operations in light of a Washington State judge’s restrictions covering seven categories of contracts. This ruling comes as part of a broader legal conflict with state authorities and specific geofencing requirements that Kalshi must meet.
Restrictions on Certain Contract Categories
The Washington court’s injunction, effective immediately, prevents Kalshi from offering or facilitating contracts related to sports, elections, politics, entertainment, culture, technology, and science. To comply with this ruling, Kalshi must implement an initial geofencing system by August 19, followed by a more comprehensive system by September 2. Failure to meet these deadlines may result in penalties of up to $120,000 per day.
Federal Oversight Amid State Restrictions
Despite these state-level restrictions, the CFTC has ordered Kalshi to operate under federal regulations. This includes the continuation of contracts in categories such as commodities, climate, economic, and financial events, which remain available for Washington users. The federal directive is a response to concerns raised by Kalshi regarding New York Attorney General Letitia James’ lawsuit alleging unlicensed gambling practices.
Emerging Legal Complications
The CFTC’s actions were initiated after New York’s request for a temporary restraining order, which could halt all of Kalshi’s event contracts nationwide. In their response, the CFTC indicated that such an order would create a market emergency.
Amidst these developments, Kalshi’s legal battles are not limited to Washington. The company has been contesting New York’s actions, arguing that its CFTC registration grants it federal authority that supersedes state laws. Legal experts suggest that New York may challenge this position, potentially escalating the ongoing legal discourse.
State Authority vs. Federal Regulations
The ongoing case underscores a significant tension between state and federal jurisdiction concerning regulation of prediction markets. Washington Attorney General Nick Brown asserts that Kalshi’s offerings fall within the scope of state gambling laws regardless of federal registration, pointing to instances where Kalshi has allegedly profited from unlicensed betting.
As federal and state authorities continue to navigate these conflicting regulations, Kalshi maintains that its operations are fully compliant with federal law, seeking to reinforce its position as a CFTC-registered exchange.
