CFTC to Discuss Crypto Regulation at August 20 Meeting Amid Legislative Delays

The Commodity Futures Trading Commission (CFTC) will conduct its first Innovation Advisory Committee (IAC) meeting on August 20, focusing on crypto regulation, artificial intelligence, and prediction markets. This meeting comes as Congress postpones action on the comprehensive digital asset market structure legislation, known as the CLARITY Act.

Agenda for the Meeting

The CFTC’s agenda for the IAC meeting includes examining the opportunities to modernize existing rules while utilizing the agency’s current statutory authority. CFTC advisers will not be voting on any specific crypto rule, but their discussions aim to inform potential future congressional legislation. The meeting is set to begin at 1 p.m. ET in Washington and will be streamed to the public.

Current Status of the CLARITY Act

The CLARITY Act is awaiting a Senate procedural vote, scheduled for September 15. Although the bill has not failed, it requires sufficient support to pass the Senate’s 60-vote cloture threshold. Without achieving this, any further progress towards legislative changes for the digital asset market remains uncertain.

Changes in SEC Schedule

Additionally, the SEC has recently canceled its planned meeting for August 14, which was intended to discuss tailored rules for crypto asset investment contracts. This cancellation brings further uncertainty to the regulatory landscape, leaving the CFTC’s session as the only forthcoming discussion on crypto regulation.

Looking Ahead

As industry stakeholders and the public prepare for the CFTC meeting, written comments can be submitted until August 27. With the CFTC currently led only by Commissioner Michael Selig, the agency’s capacity to address major policy changes in the crypto space is limited due to its understaffed structure. Nonetheless, the upcoming discussions on August 20 may help shape future priorities for crypto regulation in the U.S.
