Former U.S. Defense Secretary Mark Esper has urged Senate lawmakers to prioritize the passage of the CLARITY Act, advocating for its recognition as a critical national security issue as well as a regulatory measure for the digital asset market. His remarks were shared in a recent op-ed for the Financial Times.

A Call for Legislative Action

Esper emphasized that the CLARITY Act is essential for addressing national security concerns linked to the growing digital asset landscape. He characterized the bill as not just a financial services initiative but also a vital component in safeguarding the U.S. against threats from foreign adversaries.

Senate Majority Leader John Thune has filed a cloture motion, setting a procedural vote for the bill on September 15, shortly after the Senate reconvenes from its August recess. This vote will determine whether the bill will proceed to further discussion.

Strengthening U.S. Digital Asset Regulations

The updated CLARITY Act aims to enhance the Treasury’s authority over digital asset transactions linked to foreign money laundering issues. Esper argued that clearer regulations could help combat abuses of digital currencies by North Korean actors and mitigate the potential risks posed by alternative payment systems developed by China.

Esper currently serves on Coinbase’s Global Advisory Council, a position relevant to his advocacy for these regulatory changes.

National Security Implications

During his commentary, Esper pointed to North Korea’s Lazarus Group, a cybercrime organization linked to significant cryptocurrency thefts, as a key example of the threats that clearer regulations might address. He posited that a more structured approach to digital assets would enhance law enforcement’s ability to monitor and enforce sanctions.

Esper’s focus on security is echoed by Senate Banking Chairman Tim Scott, who noted that the legislation could deter criminals and foreign adversaries from exploiting the U.S. financial system.

Opposition and Continued Debate

Despite support, the national security rationale behind the CLARITY Act has drawn scrutiny. Critics, including Senator Elizabeth Warren, have expressed concerns that certain provisions could inadvertently increase national security risks. Specific objections raised by the National Sheriffs’ Association highlight potential challenges in law enforcement’s ability to pursue illicit activities within decentralized networks.

Upcoming Vote as a Key Milestone

The House previously passed the CLARITY Act with a vote of 294 to 134 in July 2025, and the Senate Banking Committee advanced it earlier this year. The September 15 procedural vote represents a significant test for the bill’s prospects in the Senate. The outcome will indicate whether there is enough bipartisan support to move the legislation forward.

As the September vote approaches, the fate of the CLARITY Act remains uncertain amid tight legislative timelines and political considerations leading up to the elections. Esper’s high-profile support adds weight to the security argument but does not resolve ongoing debates about the legislation’s implications.
